A serial masturbator who played with himself at a nudist beach will not spend another day behind bars despite having his jail sentence quadrupled.

Gary Chisholm pleaded guilty in March to gross indecency in a public place after pleasuring himself as he watched two topless girls at Casurina nudist beach in Darwin in August 2019. 

He spent only two days behind bars though as the rest of his three-month sentence was suspended.

A judge on Tuesday increased his suspended sentence to 12 months because of Chisholm’s ‘persistent’ public masturbation record but did not impose any further jail time, The NT News reported.

Described by his lawyer as having ‘almost the world record in masturbating, Chisholm was convicted twice in Queensland for playing with himself as he watched swimsuit models pose for a photo shoot.

He was also convicted two more times in the NT for masturbating at a scenic swimming spot and at Casuarina beach as he stood at a woman’s feet.

Northern Territory Court of Appeal Chief Justice Michael Grant defended his decision not to send Chisholm back to prison – saying the masturbator had not committed any more offences while on bail.

The prosecution appealed the original ruling on the grounds it was ‘manifestly inadequate’.

‘[While the prison sentence] might be considered at the very lower end of the acceptable range of outcomes, it falls just short of manifestly inadequate,’ he said.

‘The respondent did, in fact, serve some time in custody, at least, for the first occasion in relation to this type of offending.’

Chief Justice Grant said though Chisholm would receive a substantial prison sentence if he was caught masturbating in public again.

Darwin Local Court heard Chisholm was ‘flicking’ his erect penis at a beach in front of teenagers at Casuarina beach on August 25, 2019.

A 38-year-old man saw what he was doing and told him to stop, before an argument broke out and police were called, the court heard.

Judge Greg Macdonald said everyone should have the right to go about their business on a nudist beach without seeing ‘acts’ like the ones Chisholm committed.
